Vas Technology Apps EULA of Use for Fotto

1. EULA

By using Fotto (the "App"), you are agreeing to be bound by these EULA, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using the App. The materials contained in this App are protected by applicable copyright and trademark law.

2. Use License

1. Permission is granted to temporarily download one copy of the materials (information or software) on Fotto Apps' website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
1. modify or copy the materials;
2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
3. attempt to decompile or reverse engineer any software contained on Fotto Apps' website;
4. remove any copyright or other proprietary notations from the materials; or
5. transfer the materials to another person or "mirror" the materials on any other server.
2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Fotto Apps at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Disclaimer

1. Fotto Apps shall have no liability for conduct in relation to your use of the App. You may not use the App unless you are the copyright holder or you have obtained all necessary rights and licenses to use all images and other material that make up your creation on or via the App.
2. The materials on Fotto Apps' website are provided on an 'as is' basis. Fotto Apps makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
3. Further, Fotto Apps does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall Fotto Apps or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the App and the materials on Fotto Apps' website, even if Fotto Apps or a Fotto Apps authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Accuracy of materials

The materials appearing on Fotto Apps' website and the App could include technical, typographical, or photographic errors. Fotto Apps does not warrant that any of the materials on its website are accurate, complete or current. Fotto Apps may make changes to the materials contained on its website at any time without notice. However Fotto Apps does not make any commitment to update the materials.

6. Modifications

Fotto Apps may revise these EULA for its website and the App at any time without notice. By using this website and the App you are agreeing to be bound by the then current version of these EULA.

7. SUBSCRIPTION. TRIAL PERIOD

This App as a whole or its certain part (additional Content) is provided on a paid subscription basis. The fee may vary depending on the period of the Subscription duration.

The Subscription will renew automatically for the same period at the end of the Subscription at the cost of the chosen package. Your Account will be charged for the renewed Subscription within 24 hours prior to the end of the current Subscription.

You may cancel renewal of the Subscription at least 24 hours before the end of the Subscription: in this case the App as a whole or its additional Content will be available to You until the end of the Subscription. In order to cancel automatic renewal of the Subscription, please, change subscription settings of Your Account. After the end of the Subscription the App as a whole or its additional Content will be available only if a new Subscription is purchased.

If You uninstall the App, Your subscription will not stop automatically. You must cancel automatic renewal of Your subscription in order not to be charged with the cost of the new Subscription.

The App provides for a free 3-day trial period. You may use the App of its additional Content free of charge during this period. Please, take into consideration that at the end of the trial period it will automatically transform into a paid Subscription for the shortest period available and Your Account will be charged for the cost of such Subscription, unless You cancel the Subscription through the subscription settings of Your Account at least 24 hours prior to the end of the free trial period.

8. USER-GENERATED CONTENT

Some of Our Apps provide You with an opportunity to track analytical data with regard to Your social network profile (e.g. Instagram). Functionality of such Apps make it possible to view not only Your posts published in a social network, but also posts of other users of this social network, if such users are somehow connected to You (for example, they “follow” You). Such posts, whether published by You or by any other person, are considered User-generated Content.

As far as You may access posts of other Instagram users, You may be exposed to potentially objectionable User-generated Content. Please, take into account that the Company neither controls nor pre-checks any User-generated Content posted on any social network.

Any kind of modifications or censorship by the Company with regard to the User-generated Content may be considered violation of human rights or copyright and may potentially mislead You.

If You have been exposed to any kind of objectionable content, You may use functionality of the respective social network to track and delete objectionable User-generated Content.

Under no circumstances shall the Company be responsible for any User-generated Content.
